Short answer

To build a forex affiliate program, start with a written policy and perhaps 10 vetted partners, then pre-approve all content, track every client to its source and monitor continuously. CySEC urges firms to use the absolute minimum number of affiliates, and it expects you to end any arrangement that breaches its terms and report it.

Should you run a program at all?

Run one only if you can supervise it. CySEC's circular C217 encourages firms either to do this work internally or to use the absolute minimum number of affiliates. That is an unusually direct steer from a regulator, and it should shape your plan.

The circular dates from 2017 and refers to the 2007 Law, which Law 87(I)/2017 has since replaced. Ask your compliance officer how CySEC applies it today. It remains the clearest statement of what a Cyprus regulator expects, and ESMA's 2023 review went on to cover collaborations with affiliates such as influencers.

A workable rule: start with no more partners than your compliance team could review in full every month. For many firms that means 10 or fewer. Grow only when monitoring has kept up.

What does the partner actually do?

Activity decides the label, so map each partner before you sign. CySEC says its use of "affiliate" applies however a firm chooses to name the person or entity.

What the partner does Likely position What follows
Hosts your banners, directs traffic, does SEO for you Affiliate under C217 Due diligence, content control, monitoring
Runs a comparison or review site Affiliate, and a comparison must be fair Check claims, sources and disclosure
Personal recommendations to named clients May become investment advice Stop and take advice
Takes orders or handles client paperwork May be a tied agent or a regulated service Registration or authorisation may be needed
Promotes you to the UK public Financial promotion Needs a lawful route, see below

Tied agents are a separate regime. ESMA's 2022 briefing says the firm stays fully and unconditionally responsible, and that an agent acts for one firm only. A partner who promotes several brokers cannot be your tied agent.

Build it in seven stages

  1. Policy. Set out who may join, which countries you accept, what content is allowed and who owns oversight.
  2. Due diligence. C217 says firms should check that an affiliate holds any authorisation or registration it needs in its own country. Add sanctions checks, a review of its existing content and a look at the people behind it.
  3. Contract. Cover the clauses listed below.
  4. Content library. C217 says material should either be prepared by the firm or be pre-approved and monitored. Provide the library, and treat anything outside it as needing approval.
  5. Tracking. Link each client to affiliate, creative and landing page. Your forex CRM should do this natively.
  6. Monitoring. Run scheduled checks plus automated scanning. C217 goes so far as to encourage a marketing intelligence tool that gathers affiliates' digital media data.
  7. Exit. Decide in advance how you stop, and what you tell people.

CPA, revenue share or hybrid?

Pay for client quality. Each model encourages different behaviour, so choose deliberately. This example is illustrative.

Client Net revenue over 24 months CPA at EUR 400 25% revenue share
A, leaves after a month EUR 200 EUR 400 EUR 50
B, moderate activity EUR 1,200 EUR 400 EUR 300
C, very active EUR 3,000 EUR 400 EUR 750
Total EUR 4,400 EUR 1,200 EUR 1,100

The totals look similar, but the behaviour is not.

Model Rewards Compliance risk
CPA Volume of sign-ups Pushing unsuitable people through onboarding
Revenue share Clients who trade more and lose more The affiliate gains from client activity, a conflict worth taking to legal
Hybrid Both Inherits both, needs clear rules

Whichever you choose, set these conditions.

  • Pay only after KYC and appropriateness are passed. Paying on registration rewards the wrong step.
  • Use a hold period, and claw back on fraud, chargebacks and rule breaches.
  • Do not pay more for larger deposits.
  • Have compliance review the plan, since firms must manage conflicts of interest.

Ask your lawyer whether revenue share suits your market at all. Rules on inducements and third-party payments vary, and we would rather you asked than assumed.

What the contract should say

  • Exact scope of activity, and countries covered and excluded.
  • A ban on unapproved content, including emails, social posts and paid search.
  • A ban on bidding on your brand or using it in domains and handles.
  • A ban on income claims, bonuses and implied regulator endorsement.
  • Clear labelling of all paid content as advertising.
  • Inclusion of your risk warning, in the exact approved form.
  • Your right to inspect, suspend and terminate at once.
  • Disclosure and approval of sub-affiliates. Banning them is simpler.
  • Data protection terms, and record retention. Affiliate tracking also touches consent, so read our note on GDPR for Cyprus business websites.

Monitoring that would stand up to questions

Write the rhythm down, and keep the evidence.

Frequency Check
Weekly Automated scan for brand mentions, new domains and unapproved ads
Monthly Manual sample of each partner's live content
Monthly Failed appropriateness and complaints by partner
Quarterly Update every partner's loss percentage and warning text
Yearly Refresh due diligence and report to the board

What to do when an affiliate breaks the rules

Follow a written protocol, because C217 is specific. If an affiliate acts outside the agreement, the firm should stop working with it and take appropriate measures, tell its clients through its website, and disclose the incident to CySEC with the affiliate's website and identity. CySEC also said it intended to publish a warning list of such affiliates, and we did not check whether that list is currently live.

Keep screenshots first, then act. Evidence often vanishes once a partner learns you have noticed.

UK rules are stricter on approval

If your affiliates reach UK consumers, take this seriously. The FCA says unauthorised people, such as influencers, who promote a regulated product without approval from an appropriate authorised firm may be committing a criminal offence. In February 2026 it announced that seven influencers had been sentenced for promoting an unauthorised forex scheme, with fines of up to GBP 3,750 plus costs.

Approval has been tightly controlled since the gateway began. An authorised firm needs FCA permission to approve promotions for unauthorised persons, subject to exemptions, and one exemption covers a firm approving its own promotions for communication by an unauthorised person. Have UK counsel confirm which applies. The FCA also expects firms working with affiliate marketers to take proactive responsibility for their promotions, so treat FG24/1 as required reading.

What is coming next

The Commission's request to ESMA of 30 July 2026 describes the Retail Investment Strategy as reinforcing firms' responsibility when using distributors, social media and finfluencers. It describes written agreements defining promotional activity, internal controls, and records of all marketing, including third-party promotions, for at least five years, or up to seven on request. Application is estimated for about July 2029. Build to that standard now, because it will cost less than retrofitting.

Next step

List every partner you have today, and put each one in the first table. Anyone you cannot place is your first problem. Then read the CySEC marketing rules before you approve your content library. If you would rather grow through channels you control, our fintech and forex SEO service is the alternative we would suggest pricing up first.

Frequently asked questions

How do forex broker affiliate programs usually pay?

Most use a fixed fee per qualifying client, a share of net revenue, or a blend of the two. Each rewards different behaviour. Define qualifying carefully, and take legal advice on any structure that pays more when a client trades more.

What is the difference between an affiliate and an introducing broker?

Terms vary, and labels matter less than activity. An affiliate generally promotes and sends traffic. An introducer may have a closer client role. Once someone advises clients or handles orders, regulated activity may be involved, so have counsel review what each partner really does.

Are forex broker affiliate marketing programs legal?

Yes, where run within the rules. The firm stays answerable for its marketing, and the affiliate may need its own authorisation in its country. Some countries restrict particular forms of paid promotion, so check each market you plan to accept traffic from.

How many affiliates should a broker have?

As few as you can properly monitor. CySEC encourages the absolute minimum. A useful test is whether your compliance team could check a sample of every partner's content each month. If not, you have too many.
